How does Mediation work? Mediation is a form of alternative dispute resolution.
Mediation avoids or ends litigation if the participants can find agreement. For so many, filing a lawsuit or fighting to the bitter end can appear to be the road to vindication.
However, many don’t realize how much lawyer fees and costs can soar out of control; endless motions are filed and cases can drag on for one, even two years or more with continuances or new attorneys coming into a case. Finally, most cases end up settling before trial-something that could have been done very early in the dispute with Mediation.
Mediation provides a buffer from the financial, relational and emotional damage of the traditional court process. Unlike adversarial court processes or drawn-out family battles, mediation allows for parties to raise and negotiate their concerns in a confidential environment, focused on problem solving while reaching a mutually agreed solution.
The mediator’s role is to facilitate the reaching of a mutually acceptable agreement by both sides. Unlike a judge, who is bound by law as well as the rules of procedure and evidence, a mediator does not enforce any decision or “decide” for either side. The mediator is a Neutral, whose job is to assist both sides with getting to a solution that works for them.
Mediation is usually faster. While many mediations are completed in just a day or part of a day, this is faster than Court cases which can and often do drag on for a year, two years or more.
Finally, Mediation can ultimately save you potentially thousands to hundreds of thousands of dollars in attorney fees and costs. Even in the rare case that mediation does not result in an agreement between the disputants, you have lost nothing related to your legal rights by attending a mediation session.
